MARLIN, TX — In a hearing on Friday, the Falls County District Attorney, Jody Gillian, told the city of Marlin they have until 4:30 p.m. to produce documents related to a forensic audit ordered in November.
The city agreed to provide the information during the hearing, calling it a profound misunderstanding.
In November, the city found over $600,000 discrepancies in checks - leading to the audit. The audit was conducted by a firm in Houston.
The district attorney sent a subpoena requesting the documents twice.
Mayor Carolyn Lofton said they did not respond to the demand because the audit is still pending, and they said no one has officially been charged with wrongdoing.
To respond to the subpoenas, the city attorney filed to end the request on Thursday, but did not ask for an emergency hearing, according to the mayor.
This lead to Cedric Davis missing the convening of the grand jury, where she then filed a writ of attachment,.
