Affidavit: Victim of McDonald's shooting was meeting suspect to resolve differences

KILLEEN, TX — A man has been arrested and charged with aggravated assault with a deadly weapon in connection with the shooting at a Killeen McDonalds on Oct. 22.

Killeen police said at approximately 11:58 a.m. on Tuesday, officers responded to a call of shots fired at the McDonald's on 109 East Rancier.

When officers arrived, they found an 18-year-old victim suffering from a gunshot wound to his back. The victim was airlifted to Baylor Scott and White in critical condition.

Police said the victim and suspect were involved in an altercation and knew each other. The altercation began after animosity between the suspect and the victim's family members after the suspect was accused of domestic violence.

The suspect and victim had been texting when the suspect asked the victim to meet him at the McDonalds to resolve their differences.

When they arrived and got out of the car, witnesses say the suspect approached them and started shooting at the victim and witnesses. That's when the victim suffered a gunshot wound to his back.

Police located the suspect, who then fled on foot from police. Witnesses gave police descriptions of the suspect and officers were able to canvas the area.

At 12:20p.m., the suspect was located and taken into custody. According to the affidavit, he was found in the backyard of a residence in the area and police said shell casings and a partially loaded 9MM were also found in the same area where the shooting was reported to have taken place.

Police viewed and photographed the text messages between the suspect and victim that show the suspect setting up a meeting with the victim during the course of an "obvious argument and heated text message exchange," according to Killeen police.

The suspect has been identified as Joshua Dasilva. He is being held at Bell County Jail on a $203,000 bond.
